Safeguard in Your Consumer Paperwork

There is no getting around it. We live in a litigious world. Gone are the days when someone picks up the phone to call you in the event of a misunderstanding. It seems that legal action is the first action rather than the last. 

In order to safeguard your business, you may want to include certain things in your consumer paperwork. Consider the following examples as consumer disclaimers:


  • Legal Actions and Collections: "If {Business Name} requires third-party debt collection or legal assistance to collect an account, {Consumer Name} agrees to pay the cost incurred for such collections, including applicable court costs, attorney fees, and third-party debt collection fees."
  • Cell, Text, and Email Consent: "I, {Consumer Name}, consent to receiving emails, texts (SMS), auto-dialed and or artificial or pre-recorded message to my cellular phone or to any telephone number or email provided by me to {Your Business Name} or its affiliates and their agents including, without limitation, any account management companies and independent contractors including debt collectors. I understand that consenting to the above is not required before I receive service from {Your Business Name}."
  • Understanding and Acceptance: "{Consumer Name} confirms that he/she has read and understood and accepted the terms of this document and he/she is duly authorized to execute and accept its terms."
If you do not have the space on your current paperwork to add additional information, consider creating a separate form for consumer authorization. There are many other things to take into consideration when safeguarding your business through your consumer paperwork. Consider starting with these three examples.
