Immediately Communicate Attorney Involvement

When two parties cannot work out a disagreement, or when two parties simply need an arbiter to clarify a matter, attorney representation is more than likely needed. Collection agencies have obligations to forward all consumer communications to the consumer's counsel once counsel has been retained. Please communicate the following:


  • Inform your agency immediately when a customer retains an attorney for an account you have placed in collections.
  • Inform your agency of the communications your office had with the attorney.
    • Did the attorney request a settlement?
    • Did they threaten to sue?
    • Are there any pending lawsuits with your office related to the account now represented by the attorney?
Attorney representation is needed when two parties cannot agree and must seek judgment from the courts. Timely communication when an attorney is involved is crucial for the proper handling of the consumer account.
